WHAT ARE THE TERMS AND CONDITIONS?

  • This Booking Policy (“Policy”) deals with advance booking by customers of Jeep® Compass (“Vehicle”), a new product to be marketed and distributed by FCA India Automobiles Private Limited (“FCA India”/ “Manufacturer”/ “Company”) in India through its network of FCA Authorised Dealer(s) (“Dealer”).
  • “Customer” means any person resident in India including an Individual (18 years and above)/ Partnership Firm / Proprietorship / Company / LLP / Trust / Society or any other Person entitled to enter into a contract as per Indian Laws (“Customer”), who is interested to buy the Vehicle, may choose to buy the Vehicle as per this Booking Policy.
  • Applicability of the Policy : This Policy is applicable to Customer(s) and shall be deemed to be read, understood and agreed by the Customer(s) from the moment Customer(s) enter into bilateral transaction with Dealer through any of the below mentioned modes of booking of the Vehicle. The offer to book the Vehicle in advance subject to these terms and conditions is optional and the customer may choose not to book the Vehicle and rather buy it from the Dealer subject to availability of Vehicle. The advance booking using this online facility is also optional. The Vehicle may be purchased without an advance booking as per these terms and conditions. FCA India reserves the right to revise the specification, standard fitment, colours and/or accessories of/for the Vehicle or introduce new variants or their versions or discontinue earlier variants or versions without prior notice.
  • Modes of Booking: The Customer(s) may choose to buy the Vehicle by contacting a Dealer from those listed on the www.jeep-india.com (“JEEP Website”) OR through Online facility provided for booking of the Vehicle on www.jeep-india.com (“Online booking”) as per the terms and conditions as more specifically mentioned therein for online booking. In the event that the Customer(s) intends to book more than one Vehicle, only one Vehicle can be booked in one Booking session as per this Policy. In other words, one vehicle can be booked per booking.
  • Parties to the Transaction : The Customer(s) acknowledges and understands that the booking of the Vehicle will be an independent choice of Customer(s), basis which the Customer(s) will directly enter into a bilateral transaction for Online booking or Offline booking of the Vehicle as the case may be, with such selected / concerned Dealer as Customer may independently select by paying booking amount of INR 50,000 (“the Booking amount”) to concerned Dealer along with necessary personal details to complete the booking transaction. In case of offline booking, the all formalities with respect to purchase of Vehicle, including but not limited to the registration process shall be performed by the concerned Dealer. FCA India shall not be liable or responsible for the booking or booking amount since the booking herein is and shall be an independent bilateral transaction between Customer and Dealer. The collection of booking amount and the delivery of the Vehicle shall be the sole responsibility of the Dealer.
  • Customer(s) Duties: Prior to booking the Vehicle, the Customer(s) is/are advised to thoroughly read and understand specifications, updated specifications if any, features and colours of Vehicle posted on the official JEEP Website and/or with Dealer. The variant chosen of the Vehicle by the Customer(s) are subject to change and would be updated on the JEEP Website from time to time and shall be subject to availability at FCA India and / or the concerned Dealer. The price of the Vehicle shall be as applicable on the date of invoicing of the Vehicle. The prices are subject to change without prior notice. The Company and Dealer are not responsible / legally bound to inform Customer(s) in advance, the Customer(s) are thus advised to diligently read and accept terms and conditions of the booking of the Vehicle.
  • Personal Data and Information : By choosing to do booking of the Vehicle as per the terms and conditions under this Policy, the Customer(s), acknowledge, understand and agree to provide his/her/its required personal data and information and gives consent for its use in correspondence related to booking, store, transfer or disclose the same to the intermediaries involved in the transaction for the purpose of and in relation to the booking of the Vehicle at the time of booking and as may be requisitioned by the concerned Dealer subsequent to the booking. The Customer accepts and agrees to the above terms and conditions and also gives his unconditional consent for being contacted for FCA Products/Services over your telephone/mobile phone/email/SMS. Non-acceptance of any of these terms and conditions will result in disqualification of booking transaction. The Customer(s) agree to provide correct and valid information and also agree to keep the Dealer and / or Manufacturer indemnified for any loss, damage, claim, costs (including legal cost), expenses, or penalties arising out of any false, incorrect or misleading information provided by the Customer(s) at the time of or after the said booking of the Vehicle.
  • Confidentiality : Each party to the booking transaction shall be subjected to the provisions of Information Technology Act, 2000 and rules and regulations framed thereunder, including the Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Information) Rules, 2011 (together, “IT Laws”), in connection with collection, receipt, processing, storage, dealing, handling, use and disclosure of any “Personal Information” or “Sensitive Personal Data or Information” (as defined under the IT Laws), including obtaining all requisite consents, implementation of a privacy policy and security practices and procedures provided under the IT Laws.
  • The Transaction: The Customer(s) agrees and acknowledges that the Dealer is not obliged to treat the booking as confirmed order until and unless the booking amount is received by the Dealer from either of the Modes of Payment prescribed herein along with the dully filled Order Taking Form (“Form”) from the Customer. The booking shall be binding only after the receipt of the full balance price of the Vehicle and submission of requisite supporting documents. Until then, the booking is merely a request on part of the Customer(s) and an Offer to sell the Vehicle on the part of the Dealer to be not deemed as booking confirmation or contract of sale and does not impose financial implications on FCA India or the Dealer except as provided herein in these terms and conditions.
  • After online submission of the form with the supporting documents required by the Dealer and successful online payment transaction, the system will generate a Booking Reference Number and receipt of payment towards the booking amount. The Customer shall use the reference number and receipt to communicate with the Dealer. Customers to retrain the receipt of booking amount paid online or offline for any further transaction.
  • Pursuant to the Online booking, the Customer will be contacted by the concerned Dealer in the respective city.
  • No changes and/or modification are allowed online for Vehicle after the Booking has been made. For any change/modification, the existing booking is supposed to be cancelled and the fresh booking is required to be made.
  • Payment for Booking: Acceptance of booking amount paid by Customer(s) is routed to the Dealer’s account in the both the Offline booking of the Vehicle as well as Online booking through Jeep Website.
  • The online booking engine is available at JEEP Website whereas payment gateway is powered by the Intermediary providing payment gateway and merchant services.
  • Payments made by the Customer(s) for online booking of the Vehicle through payment gateway are subject to the terms and conditions as provided by the payment gateway intermediary/merchant service provider. FCA India or the Dealer would not be responsible for any non-payment or wrong payment made in respect of the booking through the payment gateway. In case of such an event the user/Customer(s) needs to contact the customer’s bank for chargeback, refund, etc.
  • The Customer(s) will be required to pay amount the Booking amount at the time of booking of the Vehicle. The Booking Amount can be paid by Cash/Cheque/DD/ Debit Card/ Credit Card/ Internet Banking for direct and online booking as per applicable mode. The Customer(s) needs to produce the relevant documents like PAN card as and when demanded by the Dealer. Processing/convenience fee (if any) will be borne by the Customer(s).
  • The Booking amount paid by the Customer(s) shall be adjusted against the Purchase price of the Vehicle at the time of invoicing.
  • Delivery of JEEP COMPASS: The sale and delivery of the Vehicle shall be subject to fulfilment of all applicable statutory obligations and submission of requisite supporting documents. The originals of supporting documents for booking as requisitioned by the Dealer will be required within a stipulated time for completing the booking of Vehicle. In the event of the Customer(s) fails to comply with the requirements raised by the Dealer, the booking shall stand cancelled.
  • It shall be the responsibility of the Dealer to communicate the Expected delivery date and tentative waiting period (if any) depending on demand and availability of the vehicle at the time of or after the booking.
  • The Customer(s) is/are required to follow the cancellation/refund procedure as mentioned herein.
  • Cancellation, Modification, Refund – for all bookings: Cancellation / Change in booking of the Vehicle will be effected by the concerned Dealer only upon the Customer’s request.
  • The booking amount includes convenience charges and applicable taxes. There will be no charges on cancellation of booking, but convenience charges and taxes are non-refundable.
  • Refund would be made by the Dealer directly to the Customer(s) in the online or offline mode other than cash within 30 days’ period from the Date of Cancellation. No interest will be paid to the Customer on booking amount upon cancellation of booking. There will be no deductions by the Dealer in the booking amount at the time of refund of booking amount to the Customer upon cancellation of booking by the Customer. However convenience charges and taxes levied by the payment aggregator are non-refundable.
  • If any other amount is paid offline by the Customer(s) to the Dealer towards the price of the Vehicle, accessories or any statutory requirement, then the Customer(s) is entitled to recover such amount offline from the Dealer and no online transaction shall be made in this regard.
  • Reservations and Indemnifications: The Manufacturer reserves the right, at its sole and absolute discretion, to stop, withdraw or suspend the facility of booking via any mode without any prior notice. The bookings already made by the customer will remain valid and will be serviced by the concerned Dealer as per the terms and conditions herein.
  • FCA India reserves the right to alter any terms and conditions or the booking process at its sole discretion as and when considered necessary. Reasonable efforts will be made to keep Customer(s) informed of such changes.
  • The Manufacturer reserves the right to change the colours, variants, variant names and specifications at its own discretion and right to redirect the sale transaction of the Vehicle to any other Dealer from the concerned Dealer selected by the customer, for the purpose of the delivery of the Vehicle, after the consent of the Customer(s) for such re-direction.
  • FCA India, it’s Directors, Employees, and the Dealers, Consultants assume no liability whatsoever for any direct or indirect loss or damage arising from a Customer(s) application for purchase of the Vehicle as per this Policy.
  • The Manufacturer or concerned Dealer will not be responsible for any delay, loss or non-receipt of online payment, prerequisite booking information or documents, and shall not assume any liability for any inability or failure on their part in executing any order registered by any customer on account of any causes, constituting a force majeure or otherwise, beyond their control and which is not contemplated herein. In case of any dispute, inconvenience or loss due to an act or omission of the Customer(s), the Customer(s) agrees to indemnify FCA India and the Dealer.
  • These terms and conditions shall be governed by Indian laws. The courts of Mumbai shall have exclusive jurisdiction.
  • TDR/ Convenience fee will be charged on the basis of payment what mode the user chooses at the time of transaction.
